New Jersey Appellate Court
Upholds A Foundational Institution, Marriage!
Trenton – The New Jersey Family Policy Council is pleased with the Superior Court of New Jersey, Appellate Division ruling in the Lewis v. Harris case, which upholds marriage as the union between only one man and one woman by a 2-1 decision.
“We’ve said all along that legislators and judges both have constitutionally proper roles to play,” said Len Deo, executive director of the New Jersey Family Policy Council. “Defining marriage is the business of the legislature, and that’s how the majority opinion sees it.”
“The legislature should set social policy and approve laws for the entire state of New Jersey and the judiciary should interpret the law. This ruling sets the standard that New Jersey law clearly defines marriage. It is between one man and one woman. The majority opinion affirms the foundational principles of marriage. We must save marriage from falling victim to a political agenda driven by a minority wanting to impose its will on the rest of the state, and the Court affirmed that, especially for us in New Jersey,” Deo said. The legislature has also responded by enacting Domestic Partnerships for those who cannot get married.
“Simply eliminating an entire gender from the picture and still calling it ‘marriage’ is not a mere expansion of an institution, but rather the destruction of a core principle of society,” Deo added. “It is analogous to removing one side from a square; by doing so the square loses its shape and becomes a triangle.”
“Advocates for same-sex ‘marriage’ do not like the democratic process of going through the legislature,” Deo said. “That’s why they file lawsuits instead of introducing legislation. They know that Americans believe in marriage as a male-female union. It will be better for everyone in New Jersey if the judiciary will energetically pursue its proper role, which is to interpret existing law and not to create new law, that is the role of the legislature,” said Deo. “The future of our children depends on it.”
“The bottom line is people can already choose their lifestyle, but they don’t have the right to redefine marriage in the process,” Deo stated. “Only marriage between a man and a woman should be valid and recognized in New Jersey. New Jersey and marriage, husband and wife, perfect together.”
The New Jersey Family Policy Council and other pro-marriage organizations’ efforts are being supported by the Center for Marriage Law and the Alliance Defense Fund, non-profit litigation law centers, which support one man and one woman marriage as one of their central precepts.
